In Getting Libertarianism Right, Hoppe argues a private law society needs impartial outside judges, whereas a territorial monopolist judging disputes involving itself bars appeal and provokes conflicts it decides in its favor. Legislation displaces discovered law, he predicts, and justice seekers pay compulsory tax.
Democracy, he adds, opens that monopoly judgeship to any adult for short terms, so each election restarts competition over legislation and tax revenue, raising legal uncertainty and shortening horizons while revenue buys supporters.
Emigration, Hoppe notes, leaves immovable property under the old jurisdiction; secession would change the jurisdiction itself. Calling that exit barred everywhere in 2018, he backs private intellectual networks to sustain a counterculture, though they meet under state law.
Hoppe concedes property theory cannot settle group inequalities, then endorses white heterosexual male dominance, a claim needing evidence beyond his ownership premises.
Readers can test his democratic forecast with the method his closing memoir credits to Rothbard: find who gains, then research actual money flows before assigning responsibility.
