Free Culture

Lawrence Lessig's Free Culture (2004) traces how American copyright, born to shield publishers from pirates, grew into a weapon against nearly any reuse. Defending copyright, he measures its reach in paperwork.

Jon Else's documentary caught four and a half incidental seconds of The Simpsons; Fox asked $10,000. Lessig and Else judged the use fair, but broadcast required insurance from carriers wary of fair-use claims, so Else, broke, replaced the shot. Vague lines and heavy liability shrink usable fair use.

Alex Alben's team spent a year clearing performers' rights for an Eastwood CD-ROM retrospective that sold well. Alben argues known per-minute prices would let producers budget and raise money; possible holdouts make financing hard. Lessig suggests statutory fees, which invite the price-setting objection.

Sharing exercises ownership: copyright lets the GPL oblige anyone modifying and redistributing a program to share source. Creative Commons extends voluntary grants to culture, though noncommercial terms fall outside open source.

These cases trace mechanisms without totaling lost creativity; the book suits producers diagnosing clearance friction. Full text at ibiblio.
