Hennessey’s GiveSendGo page, titled “Stand with Jaxton Collins,” describes the case as free-speech prosecution of a young man who “said the obvious out loud” about “H-1B lottery winners” and others who, the description states, “fail to assimilate,” send remittances abroad, and undercut American workers. "Why are Indians in Montana anyway??”

Court documents state that Helena police responded around 7 p.m. on August 7 after someone called and reported that a man in an orange shirt and large cross necklace approached his friend, who is of Indian descent and wears a head covering, shoved him with both hands, and told him to go back to his country. Collins later told officers he had been drinking at a bar and admitted shouting the words because he was angry, but he denied any shove, according to a report from the Billings Gazette.
